Throughout the site, the terms “we”, “us” and “our” refer to Shiny Living Dex. Shiny Living Dex offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

We reserve the right to refuse Service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

PRODUCTS & SERVICES
Our products or Services are available exclusively online through the website. We sell digital guides that you will receive on your pc, tablet and smartphone, in PDF format. Every guide contains also a free Living Dexes that you will receive on your Nintendo Switch and Nintendo Switch 2 console. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

STRATEGIC GUIDES AND LIVING DEXES
When purchasing a “Living Dex collection", the customer is purchasing a specialized PDF guide for the corresponding Pokémon game (for example, Pokémon Scarlet & Violet). Each guide is the result of extensive research, testing, and refinement carried out over several years. As a complimentary free bonus, every guide includes access to a Living Dex, meaning a complete Pokédex of all Pokémon compatible with that specific game. These digital Pokémon are legal and can be transferred to the customer’s own save file and used from the very beginning of the game, or even after the game has already been completed. Even in online battles. It is essential to understand that the Living Dex itself is provided free of charge as a gift. The customer is paying for the PDF guide, not for the Pokémon. Furthermore, all guides are updated free of charge over time with improvements, new maps, and advice. No other Pokémon store (as of September 2025) offers this unique service, designed to protect both us as a seller and you as a customer. This service is entirely legal and compliant with applicable laws in Europe, America, and worldwide.

SINGLE POKÉMON PURCHASES
When purchasing a single Pokémon, the customer is first and foremost paying for the experience of performing an online trade, as well as for our expertise in competitive Pokémon knowledge. Each of our Pokémon has a moveset carefully optimized for online battles, based on months of research, studying competitive strategies, and personal testing. What the customer is purchasing is therefore our time, research, and competitive expertise. For Level 1 Pokémon, the customer receives a hatched Pokémon with perfect 6 IVs and he's paying for the Master Ball included with it. We always strive to provide 100% legal Pokémon, authentically obtained within the games, fully transferable and depositable in Pokémon HOME. Unlike some other vendors, we guarantee that all Pokémon delivered are legal copies. In over five years of activity, no customer account has ever been banned for using our service. One of our top priorities is to remain fully up to date in order to guarantee both legal Pokémon and reliable guides that include updated maps and helpful advice for all Pokémon enthusiasts.  Once the customer has confirmed and submitted custom requests for an individual Pokémon - including, but not limited to, gender, nature, held item, and/or a custom Trainer name for a Living Dex or bundle - requests cannot be changed at a later stage. This policy is necessary to avoid repeating the preparation process multiple times, which may cause delays for other customers and their orders. Customers are therefore responsible for carefully reviewing all customization requests before confirming their order.

DELIVERY TIMES OF STRATEGIC GUIDES AND LIVING DEXES
All products sold on our site are digital goods. Customers will not receive any physical items by mail. During checkout, an address may be requested solely for billing and invoicing purposes.

The PDF guide included in every purchase is delivered immediately after payment. Please check your email inbox (and your spam or junk folder, especially if you use providers such as Outlook) to ensure you receive the guide without delay. The “Immediate Delivery” description on our products specifically refers to the guide. The complimentary Living Dex provided with each guide is delivered separately via QR code or using your username and temporary password. While we work every day, including weekends, and always aim to fulfill orders as quickly as possible, customers should be aware that high order volumes may sometimes result in a delivery timeframe of up to 24 hours.

By contract, we commit to responding to any customer message or clarification request within 12 hours of receipt. As confirmed by our verified Trustpilot reviews, every customer has always received their complimentary Living Dex successfully and with great satisfaction.

DELIVERY OF SINGLE POKÉMON
For customers who choose to purchase single Pokémon, delivery is carried out via in-game trade on the Nintendo Switch. This process requires that both the seller and the customer are online at the same time, connected to the game, and following the simple step-by-step instructions provided in each product listing. To complete the trade, the customer must have an active Nintendo Online subscription, which is required for online communications on the Nintendo Switch.

While we always strive to deliver Pokémon as quickly as possible, customers should understand that in some cases—such as when operating across different time zones—delivery may take additional time. We kindly ask for patience, and we guarantee that we will make every effort to provide the purchased Pokémon at the earliest possible opportunity.

ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
